Referral Agreements

Chemnick Moen Greenstreet represents many clients on the basis of association with other attorneys throughout the state. We take pride in the fact that many attorneys and law firms have the confidence in us to refer medical negligence cases or to ask us to associate in representing their clients. We are willing to review and evaluate potential claims without cost or obligation to the referring attorney. All cases receive an extensive evaluation before a decision is made to proceed with a claim or litigation.

Lead Attorney Arrangements
When a case is referred to us and a decision is made to take the case, we serve as lead counsel. Over the years, we have learned that a case must be run out of one office rather than two and that there needs to be a well-defined division of responsibilities to ensure quality representation.

As lead counsel, we handle court filings, discovery, and settlement discussions. However, we welcome the participation and help of referring attorneys and involve them in major parts of a case such as settlement discussions, mediations, or trial. In cases from outside Seattle, referring attorneys often assist in responding to discovery or otherwise help on a local basis. Associated counsel are regularly informed of case developments, and we welcome their input.

Fee Agreements
All agreements relating to a division of fees are governed by the Washington State Code of Professional Responsibility. In proposing a fee arrangement, we consider such factors as the nature of the case, the complexity, the potential damages, the work already done by the associating attorney, and the likely costs to be advanced. We welcome open discussions about fee divisions and strive to be fair as well as consistent with ethical requirements.
